Role of DomainCachet LLC and BrandCaviar LLC

DomainCachet LLC operates DomainCachet.com as a presentation and marketing company for premium domain names, domain packages, and related digital assets. Unless expressly stated otherwise in writing, BrandCaviar LLC is the owner and actual seller of the domain names and related assets presented for sale through DomainCachet.

Where a purchase proceeds through a third-party marketplace, escrow provider, registrar, or other transaction platform, the seller of record may be BrandCaviar LLC and the transaction may be completed under BrandCaviar LLC's applicable marketplace, escrow, registrar, or transfer account.

Package details

Domain packages may include multiple domain names curated and/or owned by BrandCaviar LLC and presented or marketed through DomainCachet LLC. Public listings summarize key assets and positioning points. Additional details may be provided to qualified buyers upon request. Package contents, pricing, and availability are subject to change at any time without notice. Any non-public information shared by DomainCachet LLC or BrandCaviar LLC is provided solely for evaluation purposes and may not be shared, published, or disclosed to any third party without prior written consent.

Availability

All domains and domain packages are offered on a first-come, first-served basis. Availability is not guaranteed until payment has been confirmed through the applicable marketplace, escrow provider, or other agreed transaction method. Listings may appear across multiple sales platforms simultaneously and may become unavailable at any time. DomainCachet LLC and BrandCaviar LLC are not responsible for domains sold, transferred, or otherwise removed from availability prior to completed purchase.

Sales are final

All domain sales are final. Domains and domain packages are sold strictly “as-is” with no warranties or guarantees of any kind, express or implied, including but not limited to performance, suitability, merchantability, fitness for a particular purpose, or future value. No refunds, returns, or exchanges are permitted once payment has been initiated, except where required by applicable law or the mandatory rules of a third-party transaction platform.

Payment & escrow

Purchases completed through third-party marketplaces, including Afternic, Sedo, or similar platforms, are governed by that platform’s applicable terms and processes. Direct transactions may be completed through Escrow.com or another mutually agreed transaction provider. Unless expressly stated otherwise in writing, BrandCaviar LLC is the seller of the domain assets and may be the named seller or transferor in the applicable marketplace, escrow, registrar, or transaction process. Payments are considered received only upon confirmation of cleared funds.

Ownership & authority

Unless expressly stated otherwise, BrandCaviar LLC represents that it owns or has authority to market and transfer the domain names and related assets offered for sale through DomainCachet. DomainCachet LLC acts as the presentation and marketing company and does not independently represent that it owns assets that are identified as owned by BrandCaviar LLC.

Domain transfer

Domain transfers are handled through the applicable marketplace, escrow provider, registrar, or other agreed transaction process. Transfers will be initiated after confirmation of cleared funds and satisfaction of applicable platform requirements. The buyer is responsible for providing accurate account details and completing any registrar requirements. DomainCachet LLC and BrandCaviar LLC are not responsible for delays, transfer restrictions, registrar policies, ICANN rules, marketplace procedures, escrow procedures, or other factors outside their reasonable control.

Logos & creative assets

Logos or creative assets are included only where explicitly stated in the applicable package description or written transaction terms. Unless clearly specified, a sale includes domain assets only. Ownership, license, transfer, or permitted use of any logo or creative asset is limited to the rights expressly identified in writing.

Optional preview features

DomainCachet LLC or BrandCaviar LLC may enable temporary site-display or preview features for selected visitors, including preview access to logo or animated-logo presentation features. Temporary, short-lived browser cookies may be used to control this optional preview behavior. Such cookies are used only for site-display or preview functionality, do not alter package terms, asset availability, ownership rights, purchase terms, or what is included in any sale unless expressly stated in writing, and may expire automatically after a limited period.

What’s included in the sale

The sale includes the domain name and any items explicitly identified in the package description or written transaction terms. No trademarks, copyrights, business assets, website content, code, customer data, or brand rights are included unless expressly stated in writing.

DomainCachet LLC and BrandCaviar LLC make no representation regarding trademark availability, registrability, prior use, or legal use of any domain name in any jurisdiction, industry, class, market, or business category. Buyers are solely responsible for conducting independent due diligence, including trademark searches, legal review, business-use review, and risk assessment.

Buyers acknowledge that they are not relying on any statement, implication, appraisal, positioning language, package description, domain listing, logo, creative asset, or representation by DomainCachet LLC or BrandCaviar LLC regarding trademark rights, trademark clearance, brand availability, legal use, market value, commercial suitability, or future business performance of any domain name or package.

Marketplace terms

Where a domain is purchased through a third-party marketplace, that platform’s terms and conditions will also apply to the transaction. These DomainCachet Terms & Conditions continue to apply to DomainCachet presentations, marketing materials, communications, and related matters, and BrandCaviar LLC's applicable rights and obligations as seller continue to apply to the fullest extent permitted.

In the event of any conflict between marketplace terms and these Terms & Conditions, the applicable marketplace terms will govern only to the extent required to complete the transaction on that platform and only with respect to that platform’s required processes. All other provisions of these Terms & Conditions remain in full force and effect. DomainCachet LLC and BrandCaviar LLC are not responsible for the policies, practices, availability, performance, errors, omissions, representations, or conduct of any third-party platform.

No legal, financial, or advisory services

DomainCachet LLC and BrandCaviar LLC do not provide legal, financial, trademark, investment, tax, accounting, or other professional advisory services through this website. Nothing on DomainCachet.com or in related communications creates any advisory, fiduciary, agency, professional, or special relationship between either company and any buyer or prospective buyer, except to the extent expressly agreed in a separate written agreement.

Limitation of liability

To the fullest extent permitted by law, DomainCachet LLC and BrandCaviar LLC shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, or similar damages arising from or related to the presentation, marketing, purchase, transfer, ownership, evaluation, listing, appraisal, positioning, negotiation, or use of any domain name, domain package, logo, creative asset, or related communication, regardless of the theory of liability.

Governing law

These Terms are governed by the laws of the State of Florida. Any dispute relating to these Terms, DomainCachet.com, or communications with DomainCachet LLC shall be subject to applicable Florida law, except to the extent mandatory marketplace, escrow, registrar, or other transaction-platform terms require otherwise.

Updates

DomainCachet LLC may update these Terms at any time without prior notice. The version posted on this page is the current version for use of DomainCachet.com. For a completed asset transaction, the terms applicable at the time of purchase, together with any mandatory marketplace, escrow, registrar, or separate written transaction terms, will govern that transaction.

Confidentiality

Any non-public information shared with prospective buyers is confidential and provided solely for evaluation purposes. DomainCachet LLC and BrandCaviar LLC may retain and use communications with prospective buyers for business, administrative, legal, and transaction-related purposes consistent with the DomainCachet Privacy Policy and applicable transaction requirements.
